What’s New in LexDAO
In the LexDAOism Blog, HAL explores Gensler’s misleading remarks regarding token registration and the impracticality of registration with the SEC in his article: On Gary Gensler, and Registration and Disclosure.
LexClinic has taken important steps to become a US tax-deductible charity using novel legal entity innovation - look out for more information on this soon.
LexClinic is also working with DAO Coalition to provide formal comments and recommendations on the Lummis-Gillibrand bill. The Lummis-Gillibrand Responsible Financial Innovation Act seeks to provide a federal regulatory framework for the use, taxation, and control of digital assets. While the LexClinic comments generally support the bill, they provide additional commentary to inform regulators on the best ways to incorporate DAOs safely into business and personal lives. Additionally, LexClinic will make recommendations on particular sections and definitions to provide a clear and robust framework for legislators to continue forming regulations in the industry. House JayFrank is piloting a per-season $3000 (eventually charitable) house grant issued by LexDAO’s Grants Committee, where students receive at least ⅔ of the grant.
As part of LexClinic’s HR development, Anna has spearheaded the creation of the LexDAO/LexClinic student onboarding experience via Catapult’s custom integration. The Catapult page will be ready for LexDAO members to share with their affiliated law schools and student groups in December.
The demand for clinic services from top-quality DAOs continues to be overwhelming. In December, upgrades will be applied to better handle the demand.
LexDAO is in discussions to formalize our grant procurement process. LexDAO runs on grants, and the more grants we receive, the greater impact we can have in both the policy arena and building public goods. Join the discussion in Discord if you want to participate!
LexDAO’s own Kyle Smith participated in a discussion with Hyperledger Foundation on setting digital value chain standards across the music industry. Be sure to keep up with Kyle and Web3Coalition for future events and discussions.
What We’re Reading
I’d be remiss if I didn’t mention the discussion draft circulated by DLx Law: The Ineluctable Modality of Securities Law: Why Fungible Crypto Assets Are Not Securities. Drafted by Lewis Cohen, Gregory Strong, Freeman Lewin, and Sarah Chen, this article breaks away from the countless surface-level ‘Tokens are not securities’ analyses and digs in deep, using a “strowrange” (a futuristic fruit) as an analogy to examine securities law and its relationship to crypto from first level principles.
What We’re Listening To
Law of Code Podcast - While it was a tough month to focus on anything besides the FTX debacle, you don’t have to look far to find those doing real work in the space. Jacob Robinson’s conversation with Dane Lund of Alliance covers everything from being a good attorney to the DCCPA, and is well worth your time.
