With identifiable parties using smart contracts to remove intermediaries in their agreements, and without explicit code deference, the presence of a legally enforceable contract may be a determinant for meatspace legal remedies (beyond the programmatic).
Thanks for the post - hadn’t thought of the control aspect! Will be interesting to see how the UCC contemplates control with respect to wallets. Disclosing private keys would continually create the need for new wallets - wonder if there’s an alternative available through some type of wallet holding the funds in trust.
It will be especially interesting to consider how multisig wallets are treated - how a controllable electronic record is considered when it programmatically requires the cooperation of more than one private keyholder
